1. Acceptance of Terms
By submitting this application, you agree to be bound by these Terms & Conditions. If you do not agree, do not submit this application.
2. Platform Description
SKEDNA is an online platform connecting pickleball venue owners with players, facilitating court reservations and venue discovery. We act as a marketplace and do not own or operate listed venues.
3. Venue Owner Responsibilities
- You must be the authorized owner or representative of the venue.
- You are responsible for maintaining accurate, up-to-date venue information.
- You are responsible for keeping your account credentials secure.
- SKEDNA may suspend accounts found in violation of these terms.
4. Listings and Accuracy
- All submitted information must be accurate, complete, and current.
- Misleading or false information may result in immediate removal without refund.
- Uploaded images must be your own or properly licensed.
5. Bookings and Payments
- You are responsible for confirming or rejecting bookings in a timely manner.
- Your venue's refund policy is your own responsibility.
- SKEDNA is not liable for payment disputes between venue owners and players.
6. Payments and Fees
6.1 Direct Payments for Court Fees: Players pay court booking fees directly to the venue owners through the payment methods specified in the venue listing (e.g., GCash, Maya, Bank Transfer). SKEDNA does not collect, hold, or process gross booking payments on behalf of the venue owner. Furthermore, SKEDNA is not responsible for verifying, guaranteeing, or facilitating refunds for direct payments made between venue owners and players outside of the platform.
6.2 Free Platform Access: Currently, creating a venue listing and utilizing SKEDNA's booking management tools is provided to venue owners completely free of charge.
6.3 Future Platform Fees: To ensure the continuous improvement and maintenance of the platform, SKEDNA reserves the right to transition from a free model to a paid model. This may include introducing system usage fees, transaction fees, top-up requirements, or other pricing structures in the future.
6.4 Notice of Fee Implementation: SKEDNA will provide registered venue owners with a formal notice at least five (5) days prior to the implementation of any mandatory platform fees. This notice will be communicated via the email address associated with your account or through an official platform notification. Continued use of SKEDNA after the five-day notice period constitutes your acceptance of the new payment terms. If you do not agree to the upcoming fees, you may suspend or terminate your listing before the charges take effect.
7. Platform Branding and Promotional Materials
7.1 Use of Digital and Physical Assets: To facilitate seamless bookings, SKEDNA provides venue owners with promotional and operational assets, which may include digital QR codes, direct booking links, social media graphics, and physical display materials (such as acrylic standees or posters).
7.2 Prohibition on Altering Branding: All provided assets must be used and displayed in their original, unaltered form. Venue owners are strictly prohibited from cropping, obscuring, or removing the SKEDNA logo or branding from digital QR codes and graphics, or modifying, covering, or dismantling physical SKEDNA display materials provided to the venue.
7.3 Enforcement: Proper display of SKEDNA branding is a condition of utilizing the platform's services. If a venue owner intentionally alters or hides SKEDNA's branding, SKEDNA reserves the right to issue a warning, temporarily suspend, or permanently terminate the venue's listing on the platform.
7.4 SKEDNA's Right to Promote: By creating a listing, the venue owner grants SKEDNA a non-exclusive right to use the venue's public name, logo, and uploaded listing imagery across SKEDNA's digital advertising, social media channels, and promotional campaigns to drive user traffic and platform growth.
8. Intellectual Property
All content, branding, and software on the SKEDNA platform are the property of SKEDNA. You may not reproduce, distribute, or create derivative works without our express written consent.
9. Account Suspension and Termination
SKEDNA reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent or harmful activity, or negatively impact the platform's users or reputation. You may also request account deactivation at any time by contacting us.
10. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from your use of the platform shall be subject to the exclusive jurisdiction of the courts of the Philippines.
11. Limitation of Liability
SKEDNA is provided "as is." To the maximum extent permitted by law, SKEDNA shall not be liable for indirect, incidental, or consequential damages arising from your use of the platform. In no event shall SKEDNA's total liability to you for any claims exceed the fees you paid to SKEDNA in the 1 month preceding the event giving rise to the claim.
